Clubmatic Privacy Policy

This Privacy Policy is part of the Clubmatic Terms of Service, found online at http://www.clubmatic.com/terms/terms.html.

1 Personal Information

Clubmatic collects personal information when you establish a Clubmatic account and when you use the Clubmatic Service. This information is used by Clubmatic solely to provide the Service to you. Your Club may also collect personal information; please request a copy of your Club's privacy policy for details on what personal information your Club collects and how your Club uses this information.

2 Registration

Clubmatic itself collects and uses only personal information necessary to provide the Service to your Club. All other Registration Data is collected on behalf of and for the sole use of your Club. Some Registration Data is required. For example, Clubmatic requires you to provide a valid email address and a password, which are used to uniquely identify you and permit you access to the Service. Your Club may require additional information, such as mailing address or phone number. You may decline to provide required personal information, in which case Clubmatic will not be able to provide the Service to you. All other Registration Data is optional. You may decline to provide optional personal information, in which case some Service features may be unavailable to you.

Personal information collected may include, but is not limited to:

  1. email address;
  2. password;
  3. name;
  4. street address, city, state, zip code;
  5. phone number;
  6. gender;
  7. birth date;
  8. spouse/partner name;
  9. child(ren) name(s);
  10. child(ren) birth date(s);
  11. membership term;
  12. amount paid;
  13. form of payment.

3 Children

This site is not intended for unsupervised access by children under the age of thirteen (13). In accordance with the Children's Online Privacy Protection Act of 1998 (http://www.ftc.gov/ogc/coppa1.htm) Clubmatic will not knowingly collect personal information from site visitors of this age group. All Registration Data collected about children under the age of thirteen (13) must be entered and maintained by a parent or legal guardian. Clubmatic encourages parents to talk to children about their use of the Internet and the information they disclose online.

4 Cookies

Clubmatic makes use of browser cookies to provide the Service. For a detailed explanation of cookies, please see http://www.epic.org/privacy/internet/cookies/. Clubmatic uses browser cookies to uniquely identify each Member. These cookies are created when you login to the Service. A "session cookie" is required for access to the Service; Clubmatic uses this cookie to ensure each Member sees the appropriate Content. The session cookie is temporary and expires when you close the browser or logout of the Service. In addition, each Member may opt-in to create a "persistent cookie" using the "Remember Me" automatic login feature. A persistent cookie remains on your hard drive for an extended period of time and is removed when you explicitly logout from the Service, or when it expires. The expiration date for persistent cookies is one (1) year from the cookie creation date.

5 Log Files

Clubmatic collects and logs personal information when you access the Service. Personal information collected and logged includes:

  1. date and time of login;
  2. date and time of each access;
  3. pages and links visited;
  4. IP address;
  5. browser type;
  6. referring URL;
  7. email sender and recipient addresses;
  8. date and time of email delivery.

Log information is linked to the Member account by use of the Session Cookie created at login. Clubmatic uses this information for:

  1. technical support and maintenance of the Service;
  2. capacity planning and proper provisioning for the Service;
  3. auditing, research and analysis in order to maintain, protect and improve the Service;
  4. developing new Service features.

6 Disclosure

Clubmatic will not rent, sell, lease, expose, or divulge Registration Data, access logs, or Content to any third party, except:

  1. in aggregated non-personal form to partners and affiliates;
  2. without first obtaining your express consent;
  3. as required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to:
    1. comply with subpoenas, court orders, or legal process;
    2. enforce applicable Terms of Service, including investigation of potential violations thereof;
    3. respond to claims that any Content violates the rights of third parties;
    4. respond to your requests for customer service;
    5. protect the rights, property or personal safety of Clubmatic, its users and the public.
    6. detect, prevent, or otherwise address fraud, security or technical issues.

7 Third Party Access

Administrators and other Members may have access to personal information, including but not limited to:

  1. your name;
  2. your email address;
  3. any information published in the online Member roster.

Clubmatic cannot control how Administrators and other Members use your personal information, and will not accept responsibility or liability for any information disclosed by them. You may limit the amount of information available to other Members by selecting the appropriate privacy setting in your Member Preferences. N.B. This limitation applies only to other Members, not to Administrators or Clubmatic.

8 Use

Clubmatic will not use any your personal information for any purpose except to provide the Service. If Clubmatic uses this information in a manner different than the purpose for which it was collected, then Clubmatic will ask for your consent prior to such use. Clubmatic will provide you notice before your personal information is transferred and becomes subject to a different privacy policy due to merger, acquisition, or any form of sale of some or all of its assets.

9 Data Security

Clubmatic takes data security very seriously. Clubmatic employs physical, electronic, and procedural safeguards to protect against unauthorized access to systems where we store your personal data.

Your account is protected by your personal password, which is stored in the Service in an encrypted fashion. Neither Clubmatic nor Administrators have access to your password. It is critical for you to keep your account and password secure and private to prevent unauthorized access or disclosure of your personal information.

Clubmatic permits designated employees, contractors, and agents restricted access to your personal information as needed solely in order to operate, develop or improve our services. Unauthorized access of personal data by any Clubmatic employee may result in disciplinary actions up to and including dismissal and criminal prosecution.

10 Data Integrity

Clubmatic processes your personal information only for the purposes for which it was collected and in accordance with this Privacy Policy. Clubmatic periodically reviews its data collection, storage, and processing practices to ensure that Clubmatic only collects, stores, and processes the personal information needed to provide or improve the Service. Clubmatic takes reasonable steps to ensure that the personal information processed is accurate, complete, and current. However, Clubmatic depends on you to update or correct your personal information whenever necessary. You may examine and update your personal information at any time using the Member Detail and Member Preferences pages.

11 Choice and Opt-out

You may at any time request your account be closed and your personal information be removed from the Service by contacting your Club Administrator. Some residual personal information, such as email messages you have Posted, may remain after your account is closed.

Clubmatic provides email list services for Club Members. You may opt out of any Club email by selecting the appropriate email setting in your Member Preferences. Clubmatic or your Club may from time to time send service-related announcements directly to Administrators and Members. You may not opt out of these communications. Clubmatic will never send unsolicited email (aka spam) to Members. Clubmatic will never rent, sell, or lease your Club email addresses to any third party except as provided for in Section 5, "Disclosure".

12 Customer Service

When you register or renew your membership, Clubmatic will send you a welcoming email to verify your registration. Clubmatic will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. Clubmatic will communicate with you by email or telephone, in accordance with your wishes.

13 Links to Other Sites

The Clubmatic Service may contain links to other sites that are not owned or controlled by Clubmatic. Please be aware that Clubmatic is not responsible for the privacy practices of such other sites. This privacy statement applies only to information collected by Clubmatic. Clubmatic encourages you to be aware when you leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information.

14 Changes

Clubmatic may modify or revise this Privacy Policy from time to time, for any reason, with or without notice. You agree to accept and be bound by any such modifications or revisions, even if you receive no notice. Please review this Privacy Policy from time to time so you will be apprised of any changes. Each revision of this Privacy Policy will be identified at the top of the page by its effective date.
